1. Definitions

  • “We,” “Company”: Refers to Work Sentry, operated by Little Beak Private Limited, a company registered and operating under the legislation of Surat, Gujarat, India. Our legal address is Surat, Gujarat, India.
  • “Website”: Refers to the official website of Work Sentry, which can be accessed at https://worksentry.co/
  • “Product”: Refers to the Work Sentry Time Tracker, including its desktop application, mobile application, web application, and any associated extensions or integrations. This Product is designed to assist users in tracking time, managing tasks, and improving productivity.
  • “Workspace Owner”: Refers to the individual or entity who creates and manages a workspace on the Product. This person has control over the workspace, including inviting new members, setting permissions, and overseeing workspace operations.
  • “Workspace Member”: Refers to individuals invited by the Workspace Owner to join the workspace. These members use the Product for tracking their work time and productivity.
  • “You”: Refers collectively to both Workspace Owners and Workspace Members.

2. Registration

  • Access to the Website is available without registering. However, to fully utilize the Product, you must subscribe and agree to these Terms of Service.
  • To register for a subscription, you must provide your first name, last name, email address, and create a secure password. You are responsible for maintaining the confidentiality of your password and for any activities that occur through your account.
  • After registration, you will receive a verification email. Although email verification is not required during the trial period, it is mandatory to continue using the Product beyond the trial.

3. Consent to Processing of Personal Data

  • By accessing our Website and using the Product, you consent to the collection, use, and processing of your personal data as detailed in our Privacy Policy. You are required to provide accurate and complete information and to update it as necessary. We are not liable for any issues arising from outdated or incorrect information.

4. Subscription Plans and Fees

  • The Product is available free of charge during an initial trial period, which is specified on the Website. After the trial period, Workspace Owners must select a subscription plan and make payment to continue using the Product.
  • Subscription fees are charged based on the number of Workspace Members and the selected plan (monthly or yearly). Charges commence on the first day after the trial period ends. All payments are processed electronically through licensed payment service providers, and we do not store payment information. Responsibility for handling payments lies with these third-party providers, and you may review their privacy policies.
  • Workspace Owners have the flexibility to change their subscription plan, including upgrading or downgrading, at any time. Such changes will be applied at the end of the current billing cycle unless otherwise agreed.
  • Failure to make timely payments may result in suspension or termination of access to the Product. Unpaid subscription fees signify discontinuation of use of the Product.

5. Refunds

  • No refunds are available for unused portions of a subscription period once purchased. However, refunds are available within 15 days of payment for monthly subscriptions and within 30 days for yearly subscriptions, provided a refund request is made within these time frames.
  • For balance refunds, if applicable, requests must be made within 30 days of the refund request.

6. Use of the Product

  • The Product should be used only for its intended purpose, as described. Unauthorized activities, including but not limited to spreading malware, conducting automated data collection, or engaging in other harmful actions, are strictly prohibited.
  • You must not use the Product in a manner that could harm its functionality or disrupt its operation.

7. Account Suspension

  • We reserve the right to suspend or terminate accounts if there are violations of these Terms of Service, illegal activities, or failure to comply with applicable laws. This includes suspension due to non-payment or complaints from other users.
  • We are not liable for any damages resulting from account suspension or termination.

8. Account Deletion

  • Workspace Owners may delete their accounts at any time. Account deletion will result in the removal of the workspace and all associated data. Upon request, we can also delete Workspace Members’ accounts, provided they are not part of multiple workspaces.

9. Content and Linking

  • We are not responsible for the content of third-party websites or applications linked through the Product. Use such third-party services at your own risk and review their policies regarding data handling and privacy.

10. Intellectual Property Rights

  • The content and intellectual property rights associated with the Product, including text, graphics, images, and software, are owned by Work Sentry or its affiliates. Unauthorized use, modification, or distribution of this content is prohibited.
  • Trademarks and logos displayed on the Product are the intellectual property of Work Sentry and are protected by applicable laws.

11. Liability

  • The Product is provided on an “as is” and “as available” basis without warranties of any kind, express or implied. We do not guarantee the Product’s availability, reliability, or suitability for any particular purpose.
  • We disclaim all liability for damages resulting from the use or inability to use the Product, including but not limited to interruptions, errors, or issues caused by third parties or internet connectivity problems.

12. Applicable Law and Jurisdiction

  • Disputes arising from these Terms of Service will first be addressed through direct negotiations between the parties involved. If an agreement cannot be reached within 30 days, disputes will be resolved by the courts in Surat, Gujarat, India.

13. Validity and Acceptance

  • By using the Product, you acknowledge that you have read, understood, and agree to these Terms of Service. We reserve the right to modify these terms, and any changes will be effective upon posting on the Website. Continued use of the Product signifies your acceptance of the revised terms.
